Background

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Remote Work Life LLC (“we,” “us” or “our”), concerning your access to and use of remoteworklife.co website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). 

 

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

 

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

“Service” means collectively any online facilities, tools, services or information that Remote Work Life makes available through the Web Site either now or in the future;
“System” means any online communications infrastructure that Remote Work Life makes available through the Web Site either now or in the future.  This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
“User” / “Users” means any third party that accesses the Web Site and is not employed by Remote Work Life and acting in the course of their employment; 
“Web Site” means the website that you are currently using (www. remoteworklife.co).

Intellectual Property

All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Remote Work Life, our affiliates or other relevant third parties.  By continuing to use the Web Site you acknowledge that such material is protected by applicable United States and International intellectual property and other relevant laws.

You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Remote Work Life.

This Web Site may contain links to other sites.  Unless expressly stated, these sites are not under the control of Remote Work Life or that of our affiliates.  We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them.  The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.

If a third-party links to our Web site, it is not necessarily an indication of an endorsement, authorization, sponsorship, affiliation, joint venture or partnership by or with me. In most cases, I`m not are not aware that a third party has linked to my Web site.

For the purposes of applicable data protection legislation, the Remote Work Life will process any personal data you have provided to it in accordance Privacy Policy available on the Remote Work Life website or on request from Remote Work Life.

You agree that, if you have provided Remote Work Life with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to Remote Work Life and (2) that you have brought to the attention of any such third party the Privacy Notice available on the Remote Work Life’s website or otherwise provided a copy of it to the third party. You agree to indemnify Remote Work Life in relation to all and any liabilities, penalties, fines, awards or costs arising from your non-compliance with these requirements.

Remote Work Life makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service.

No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.

Availability of the Web Site

The Service is provided “as is” and on an “as available” basis.  We give no warranty that the Service will be free of defects and / or faults.  To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

Remote Work Life accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

Limitation of Liability

To the maximum extent permitted by law, Remote Work Life accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

Nothing in these terms and conditions excludes or restricts Remote Work Life’s liability for death or personal injury resulting from any negligence or fraud on the part of Remote Work Life.

Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant legal provisions.  However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions.  This term shall apply only within jurisdictions where a particular term is illegal.

The Customer shall indemnify Remote Work Life against all damages, costs, claims and expenses suffered by  arising from loss or damage to any equipment (including that of third parties) caused by the Customer, or its agent or employees.

Your Account

Using our Services, requires you to register with us and to open an account. At the time of registration, you agree to provide us with the personal and other information that are necessary to offer you our Services. Those must be true, accurate, complete, and kept up to date. You should note that a failure to provide true, accurate, complete, and up to date details forces us to end the relationship with you and to immediately terminate the Services offered to you. Also, that you are responsible for all activity on your account, whether you authorize it or not.

To access your Account, you will be required to provide your member name and password. It is your responsibility to create a strong password and to protect your log in details and to restrict access to your account. You must notify us immediately if the security of your account has been compromised and you accept and acknowledge that we do not assume any responsibility for the safety of your account nor can be held liable for security breaches and activities that occur under your Account nor can accept any risks deriving from authorized or unauthorized access or fraudulent entry to your account to the maximum extent permitted by law.

Basis of Sale and Service

Remote Work Life’s employees or agents are not authorised to make any representations concerning the Goods and Services unless confirmed by Remote Work Life in writing.  In entering into this agreement, the Customer acknowledges that it does not rely on, and waives any claim for breach of, any such representations which are not so confirmed.

No variation to this Agreement shall be binding unless agreed in writing between the authorised representatives of the Customer and Remote Work Life.

Sales literature, price lists and other documents issued by Remote Work Life in relation to the Goods and Services are subject to alteration without notice and do not constitute offers to sell the Goods which are capable of acceptance.  An order placed by the Customer may not be withdrawn cancelled or altered prior to acceptance by Remote Work Life and no contract for the sale of the Goods and Services shall be binding on Remote Work Life unless Remote Work Life has issued a quotation which is expressed to be an offer to sell the goods and services or has accepted an order placed by the Customer by whichever is the earlier of:- Remote Work Life’s written acceptance; delivery of the Goods; or Remote Work Life’s invoice.

Any typographical, clerical or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Remote Work Life shall be subject to correction without any liability on the part of Remote Work Life.

The Goods

No order submitted by the Customer shall be deemed to be accepted by Remote Work Life unless and until confirmed in writing by Remote Work Life’s authorised representative.

The specification for the Goods shall be those set out in Remote Work Life’s sales documentation unless varied expressly in the Customer’s order (if accepted by Remote Work Life). The Goods will only be supplied in the minimum units (or multiples) stated in Remote Work Life’s price list or in multiples of the sales or as specified. Orders received for quantities other than these will be adjusted accordingly. Illustrations, photographs or descriptions whether in catalogues, brochures, price lists or other documents issued by Remote Work Life are intended as a guide only and shall not be binding on Remote Work Life.

Remote Work Life reserves the right to make any changes in the specification of the Goods which are required to conform with any applicable safety or other statutory or regulatory requirements or, where the Goods are to be supplied to Remote Work Life’s specification, which do not materially affect their quality or performance.

No order which has been accepted by Remote Work Life may be cancelled by the Customer except with the Agreement in writing of Remote Work Life on the terms that the Customer shall indemnify Remote Work Life in full against all loss (including loss of profit), costs (including the cost of all labour and materials used), damages, charges and expenses incurred by Remote Work Life as a result of cancellation.

The Services

With effect from the Commencement Date Remote Work Life shall, in consideration of the Fees being paid in accordance with the Terms of Payment will provide the services expressly identified in the accepted order or otherwise agreed under this Agreement. 

Remote Work Life will use reasonable care and skill to perform the services identified in the accepted order or otherwise agreed under this Agreement.

Remote Work Life shall use all reasonable endeavours to complete its obligations under the Schedule, but time will not be of the essence in the performance of these obligations.

Price

The price of the Goods and Services shall be the price listed in accepted order current at the date of acceptance of the Customer’s order or such other price as may be agreed in writing by Remote Work Life and the Customer.

Remote Work Life reserves the right, by giving notice to the Customer at any time before delivery, to increase the price of the Goods and Services to reflect any increase in the cost to Remote Work Life which is due to any factor beyond the control of Remote Work Life(such as, without limitation, any foreign exchange fluctuation currency regulation, alteration of duties, significant increase in the costs of labour, materials or other costs of manufacture), any change in delivery dates, quantities or specifications for the Goods and services which are requested by the Customer, or any delay caused by any instructions of the Customer or failure of the Customer to give Remote Work Life adequate information or instructions. 

Except as otherwise stated under the terms of any accepted order or in any price list of Remote Work Life, and unless otherwise agreed in writing between the Customer and Remote Work Life, all prices are exclusive of Remote Work Life’s charges for packaging and transport and all transportation charges, insurance and special packaging must be paid by the Customer.

Payment

All payments required to be made pursuant to this Agreement by the Customer shall be made immediately upon placing the order, without any set-off, withholding or deduction. 

Delivery and Performance

Delivery of the Goods shall be made by Remote Work Life delivering the Goods to the place specified in the accepted order.

The Delivery Date is approximate only and time for delivery shall not be of the essence unless previously agreed by Remote Work Life in writing. 

With effect from the Commencement Date Remote Work Life shall, in consideration of the amount(s) being paid in accordance with the accepted order will provide the services expressly identified or otherwise agreed under this Agreement. 

Non-Delivery of Goods and Services

If Remote Work Life fails to deliver the Goods or Services and any of them on the Delivery Date other than for reasons outside Remote Work Life’s reasonable control or the Customer’s or its carrier’s fault:-if Remote Work Life delivers the Goods and Services at any time thereafter Remote Work Life shall have no liability in respect of such late delivery; if the Customer gives written notice to Remote Work Life within 14 business days after the Delivery Date and Remote Work Life fails to deliver the Goods and Services within 14 Business Days after receiving such notice the Customer may cancel the order and Remote Work Life’s liability shall be limited to the excess (if any) of the cost of the Customer (in the cheapest available market) of similar goods to those not delivered over the price of the Goods not delivered.

Return Policy

We hope your order meets your expectations, however if you are dissatisfied with your order, or change your mind, you can return it for an exchange or refund (within 14 days from the date of dispatch).

Please contact our Customer Service team either per email support@remoteworklife.co within 14 days of your original order shipment date, quoting your order number and we will explain how to return your product(s). Please note we can only offer a refund if returned within 30 days from the date of dispatch. 

Products must be returned in their original condition and unfortunately we are unable to accept items back that have been opened or used, unless the product is damaged or defective. 

Unfortunately, your original delivery cost will not be refunded. Your return request will be processed promptly and are processed within 6 working days of receipt. 

Once your return has been processed, an email will be sent to confirm the completion of your refund or exchange. 

Refunds will only be made against the original credit/debit card used.

Once we receive and inspect your return,, we will send you an email to confirm  that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed and a credit will automatically be applied to your credit card or original method of payment. When you return a product or products, we recommend you use a trackable shipping service or purchase shipping insurance. We cannot guarantee that we will receive your returned item

No Goods may be returned to Remote Work Life without the prior Agreement in writing of Remote Work Life.  Subject thereto any Goods returned which Remote Work Life is satisfied were supplied subject to defects of quality or condition which would not be apparent on inspection shall either be replaced free of charge or, at Remote Work Life’s sole discretion Remote Work Life shall refund or credit to the Customer the price of such defective Goods but Remote Work Life shall have no further liability to the Customer.

Remote Work Life shall be under no liability in respect of any defect arising from fair wear and tear, or any wilful damage, negligence, subjection to normal conditions, failure to follow Remote Work Life’s instructions (whether oral or in writing), misuse or alteration of the Goods without Remote Work Life’s approval, or any other act or omission on the part of the Customer, its employees or agents or any third party.

Subject as expressly provided in this Agreement, and except where the Goods are sold under a consumer sale, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

The Customer shall be responsible to ensure that, except to the extent that instructions as to the use or sale of the Goods are contained in the packaging or labelling of the Goods, any use or sale of the Goods by the Customer is in compliance with all applicable statutory provisions and that handling and sale of the Goods by the Customer is carried out in accordance with directions given by Remote Work Life or any competent governmental or regulatory authority. The Customer will indemnify Remote Work Life against any liability loss or damage which Remote Work Life might suffer as a result of the Customer’s failure to comply with this condition.

Duties and Taxes

When ordering goods from our site for delivery overseas you may be subject to additional duties and taxes, which are levied once the order reaches the specified destination. Any additional charges for customs clearance must be borne by you.  We have no control over these charges and cannot predict what they may be. If these charges are unpaid, your order may be returned to us and we will be unable to refund shipping costs.

Please be aware that there may be limitations on what can be sent to you with regards to specific items and order value. You may also need to provide specific documentation for clearance of your order, once it arrives in your destination country.  This may vary from country to country and we ask that you contact your local customs office for additional information before placing an order. We cannot refund any shipping costs should your order be returned for any of these reasons.

Risk of Loss

All items purchased are made pursuant to a shipment contract with our carriers. This means that the risk of loss and title for such items pass to you upon our delivery of your order to the carrier.

If you do not receive your order within 20 working days from the date of despatch, please contact us. We would request that you contact as soon as possible and within 45 days of placing your order.  If you contact us outside of this time frame, we are unable to track your order or provide any reimbursement.

No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Notices

All notices / communications shall be given to us either by post to our Premises or by email to support@remoteworklife.co.  Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

Severance

In the event that one or more of the provisions of this Agreement is found to be unlawful, invalid or otherwise unenforceable, that / those provision(s) shall be deemed severed from the remainder of this Agreement.  The remainder of this Agreement shall be valid and enforceable.

Law and Jurisdiction

These terms and conditions and the relationship between you and Remote Work Life shall be governed by and construed in accordance with the Law of Georgia and Remote Work Life and you agree to submit to the exclusive jurisdiction of the Courts of Georgia.
